Branding - It's much ado about nothing

I sat down this morning at work, the first day back after the easter holiday, switched on my PC, sipped my coffee and then in a scene reminiscent of the closing stages of The Usual Suspects the scenery around me told its own story.

There in front of me were logos for AMD, Microsoft, Nvidia, it all suddenly made sense. The evil empire wasn't on the march to silence the minions, we weren't all being told to be silent at the back, we were being asked to treat the Linden Lab brand as, well a brand.

Indeed, just like Microsoft insist on people who sell services on the back of their name require people to correctly use logos and refer to their products.

Stunned I reached for the batphone to apologise to Catherine Linden for getting the wrong end of the stick. Alas the batphone didn't know the number and it was 1.15 am in California anyway.

So I will apologise here to Catherine and Robin, not that Robin was directly involved here but I'll owe her an apology sooner or later so I see this as a buy two get one free kind of offer. I completely misread the aims of this branding issue.

Then when I sit down and think about it more, I realise how very wrong I've got it. Inworld if you're affiliated with someone, such as -UK-Couture, Sensual Designs, Vindi Vindloo, Wrong, Reaction, Ravenwear, Ava Choo or Strokerz Toyz to name a few, you have to abide by guidelines, you have to display logos, you have to word any advertising in such a manner to make it clear that you are not actually representing those inworld business concerns directly. This is all Linden Lab are doing with this branding center.

Linden Lab are saying you can use certain logos to show that you sell products or services within their world, but you are not to represent yourself as being an employee or direct representative. This is pretty standard practice when you think about it.

The confusion I believe stems from the wording of guidelines, where they start talking about how to refer to their products in text. People were concerned that this meant we could never say certain things, but common sense needs to prevail here (which I was lacking last night). When you see articles and stories in the press about companies, do you also see trademark symbols all the time? Even Information Week don't abide by those rules and they aren't being threatened with legal action every week.

Linden Lab are trying to avoid misrepresentation, they aren't trying to silence anyone, they are highly unlikely to send in the lawyers if someone says "second Life sucks, Linden labs are rubbish". They just want business to work with them in a fashion that is pretty standard for business partnerships all over the globe.

You're completely right

As usual, this is a case of a perfectly reasonably action that's been badly communicated to the community. First of all, as you point out, there is no need for anyone to start slapping "TM" after every instance of "Second Life". If you're talking in a nominative way - ie referring to the product - and not suggesting any association between yourself and Linden Lab then you'll almost certainly fall under fair use of trademarks.

My 2 cents on the branding...

They're trying to make it such that companies can advertise Second Life on physical products. It really is of little use on the web - but on a business card, or on print advertising... it works.

Display the inSL logo to show you and your brands are a part of the Second Life community.

I almost went ahead and registered with their program, but when they got to the address part I scratched my head. I mean - do I really need to use their new design? No, not at all. Heck, I never used their Hand of Isengard emblem either. I tag things as 'Second Life', as do a few thousand other people.

So - I dunno. What surprises me most is that this wasn't pushed on the SLDeveloper lists... that is where I can see this being used the most.

It is confusing, really, for the people who don't have brands. Here's a hint and a half: If the product is in SL, guess what? You don't need the logo. :P

The use of their 'tagline' is just - well, as a writer, I think it's crap. I really do. I will demonstrate:

'My opinion. My rationalization.'

Could be seen as a twist of their tagline from their perspective. But if they try suing me over things like that, they're going to have to build a really convincing case.

Linden Labs is just trying to clean up its mess before this new "CEO" steps in. Think of whats been happening the past year.

NO BANKING
NO MORE 16M AD FARMS
NEW GUIDELINES ON USING "SL TRADEMARKS"

1st off why wasn't this stuff laid out when Second Life (Opps Do I need the Copyright, Trademark, P. Linden's approval using this word, Torleys tips of the week using this word properly in my vocabulary???) Now I know Linden Labs (Sorry again not sure if you need be to stick things afte14r this Noun.) didn't dream up people running big banks etc on it on its master vision. But don't you think you would have had better TOS etc on using the trademarks???

Linden Labs (See earlier info on this word) just has to make itself look better for a better "CEO" to want to work for Linden Labs.

Why the long process to sign up to use this new logo? Why not just say hey if you make an item on Second Life, please feel free to use this new inSL (Wait can I say inSL, I didn't register on the site about this "SPECIAL NEW WORD we just got)

Its a sneeky way of Linden Labs trying to verify people on their content. Where is that age verification thing they spoke of I think its been a year to make sure adults are adults on the Adult grid & the kiddies stay on the kiddies grid.

Linden Labs need help bad. This must be their vision of how Second Life will be improved. What happens if I make a RL Shirt with the words "inSL" on it & walk around. I don't dare go to San Fran, CA. A Linden Lab employee might see me & say hey your inRL not inSL, please takes off your shirt & return back to SL. (Remember inSL TOS states the items must actually be uses in Second Life not Real Life.

Linden Labs please inRL fix all those inRL bugs on your inSL clients we inRL people use to access Second Life inSL.

PS Any trademark, copyright, taglines, headlines, newlines, or anything else I left off this blog post I'm sorry just didn't know how to stick all those things in this. Please feel free to manually edit these logos in your mind when reading this blog post inRL after the words you see here. I'm not heading back to inSL see you guys later inRL...
